Terms and Conditions of Use

1. Acceptance of Terms

By accessing and using Script Pro, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use the application.

2. Service Description

Script Pro is a mobile application designed for creating, editing, and managing film and audiovisual scripts. The application offers the following features:

  • Creation and editing of script projects
  • Multiple project management
  • Professional script formatting tools
  • Trash system for project recovery
  • Script export in various formats
  • Settings and preferences customization
  • Dark and light mode
  • Multi-language support (Spanish, English, Portuguese)
  • Storyboard and Visual Resources Center: full-screen drawing panel, sketch tools and resource library
  • AI-assisted image generation: preview before applying generated images to thumbnails or projects
  • Integration with third-party services for advanced features (e.g., AI image generation)

3. Intellectual Property of Scripts

IMPORTANT: Aratirí Studios and Script Pro do NOT claim any ownership rights over the scripts, content, or projects you create using the application.

  • You retain all copyright and intellectual property rights to your scripts
  • We do NOT store, commercialize, or acquire rights to your content
  • Your creations are and remain your exclusive property
  • We do not sell, license, or share your scripts with third parties
  • You are solely responsible for the content you create

4. Data Storage

Script Pro stores your data locally on your device:

  • Projects and scripts are saved locally
  • Some advanced features (for example, AI image generation) may require sending prompts or data to third-party services for processing
  • We do NOT guarantee confidentiality with respect to third‑party providers: please review their privacy policies
  • We do NOT access the content of your projects except for technical exceptions described (e.g., sending data to AI services when you request it)
  • You are responsible for maintaining regular backups of your content
  • We are NOT responsible for loss of information or data. We strongly urge the user to perform regular backups and export their projects for greater security.

5. User Accounts

Script Pro offers the following access options:

  • Google Sign-In
  • Guest mode (access without account)

By creating an account, you agree to:

  • Provide truthful information
  • Maintain the security of your account
  • Report any unauthorized use

6. Subscription Plans and Refund Policy

Script Pro offers different plans:

  • Free Plan: Basic access to main features
  • Pro Plan: Advanced features and priority support
  • Premium Plan: Full access with AI and exclusive features

Subscriptions and payments are usually managed through the corresponding store (e.g., Google Play).

REFUND POLICY:

We only refund the purchase amount if ALL of the following conditions are met:

  1. The user did not use Premium tools at any time.
  2. The user did not generate text or images with AI.
  3. No more than 24 hours have passed since the purchase.

If any of these conditions are not met, we will not accept the refund request.

7. Appropriate Use

You agree to:

  • Use the application legally and ethically
  • NOT create illegal, offensive content, or content that violates third-party rights
  • NOT attempt to breach the application's security
  • NOT reverse engineer the software

8. Privacy and Data Deletion

We respect your privacy:

  • We collect only necessary information for operation
  • We do NOT sell or share your personal data
  • You have the right to delete your account and all associated data (projects, profile, backups) permanently from the app settings
  • Once the account is deleted, the action is irreversible and data cannot be recovered
  • You can consult our separate Privacy Policy for more details

9. Limitation of Liability

Aratirí Studios and Script Pro:

  • Provide the application "as is" without warranties beyond those required by law
  • Do NOT guarantee uninterrupted operation or error‑free performance
  • Are NOT responsible for loss of information or data. We strongly urge the user to perform regular backups and export their projects for greater security.
  • Are NOT liable for direct, indirect, incidental, consequential or punitive damages arising from use of the application, including those related to AI features or third‑party services
  • We recommend keeping regular backups and verifying any automatically generated results before use in critical contexts

10. Service Modifications

We reserve the right to:

  • Modify or discontinue features
  • Update these terms with prior notice
  • Change subscription prices
  • Perform scheduled maintenance

11. Termination and Account Closure

We may terminate or suspend your access if:

  • You violate these terms and conditions
  • You use the application inappropriately
  • You participate in fraudulent activities

You can delete your account at any time from 'Edit Profile' -> 'Delete Account'. This action will immediately delete your access and all your data from the server.

12. Use of Artificial Intelligence (Google Vertex AI)

Script Pro integrates artificial intelligence features powered by Google Vertex AI. By using these features, you understand that:

  • Automated Generation: Content is generated by algorithms and may contain inaccuracies, errors, or "hallucinations". Always verify the information.
  • Originality: We do not guarantee that AI-generated content is unique; the AI could generate similar results for other users.
  • Ownership: Ownership rights over AI-generated content are subject to the local laws of your jurisdiction.
  • Responsibility: You are responsible for evaluating and verifying any generated content before using it professionally.

13. Offline and Guest Mode

The application allows working without an internet connection ("Offline Mode") or without an account ("Guest Mode"). Please note:

  • Local Backup: In offline or guest mode, changes are saved only on your device. If you lose or damage the device, or uninstall the app, data cannot be recovered.
  • Synchronization: By linking an account, local data will be synchronized with the server for backup purposes.
  • Conflicts: If you edit the same project on multiple devices, the most recent version registered on the server will prevail.

14. Beta Software

You acknowledge that Script Pro may be in a development phase ("Beta"). This means that:

  • The application may contain bugs or instability.
  • Features may change or be removed without prior notice.
  • Use is at your own risk, and maintaining external backups is recommended.

15. Age Restriction

You must be at least 13 years old to use Script Pro. If you reside in a jurisdiction where the law requires an older age for data usage consent, you must meet that age requirement or have verifiable consent from your parents or guardians.

16. Third-Party Services

Script Pro uses third-party services that have their own terms:

  • Google (Firebase, Vertex AI, Google Auth)
  • RevenueCat (Subscription management)

By using the application, you also agree to be bound by the terms of service of these providers.

18. Jurisdiction and Governing Law

These Terms shall be governed by and construed in accordance with the laws of Paraguay, without regard to its conflict of law provisions, with the following warnings for specific regions:

  • United States: If you reside in the U.S., these terms are governed by the laws of the State of California. You agree to the Class Action Waiver described in Section 22.
  • Brazil: If you reside in Brazil, nothing in these terms affects your rights as a consumer under the Código de Defesa do Consumidor (CDC). Disputes may be resolved in the court of your domicile.
  • India: If you reside in India, these terms are subject to the Information Technology Act, 2000. Any dispute arising out of these terms shall be subject to the exclusive jurisdiction of the courts in New Delhi.
  • Rest of the World: For all other users, any dispute will be resolved in the competent courts of Asunción, Paraguay.

19. Acceptance

By using Script Pro, you acknowledge that you have read, understood, and accept these Terms and Conditions in their entirety.

20. User Feedback

We welcome your feedback, ideas, or suggestions ("Feedback") for improving Script Pro. By submitting Feedback, you assign to us all right, title, and interest in such Feedback. We may use your Feedback for any purpose without compensation or obligation to you.

21. Export and Compatibility Disclaimer

Script Pro allows exporting projects to various formats, including .PDF, .XLSX (Excel), and our proprietary format .SPB. While we strive for accuracy:

  • We do NOT guarantee 100% compatibility with third-party software when using standard formats like .PDF or .XLSX.
  • The .SPB format is proprietary and designed exclusively for use within Script Pro or compatible versions.
  • Formatting, pagination, or layout may vary when opened in other applications.
  • Exports are provided "AS IS". You are responsible for reviewing your script's format before professional submission.

22. Class Action Waiver (U.S. Users)

IF YOU ARE A RESIDENT OF THE UNITED STATES OR ANY JURISDICTION WHERE THIS WAIVER IS ENFORCEABLE: YOU AND ARATIRÍ STUDIOS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

23. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
